TERMS AND CONDITIONS

The following Terms and Conditions (the "Agreement") govern all use of the www.filament.co.in website (the "Site") and the services available on or at the Site (collectively, the "Service"). The Service is owned and operated by Filament Fabrics & More Pvt Ltd ("FFM"). The Service is offered subject to your (the "User") acceptance of these Terms and Conditions and all other operating rules, policies, and procedures published by FFM on the Site, including our Shipping and Return Policy.

By accessing or using the Site, you agree to comply with these Terms and Conditions.

DEFINITIONS

  • Service: All features, tools, products, and functionalities offered on the Site.
  • User: Any individual accessing or using the Site.
  • Custom-Made Products: Products made to specific User requirements, including but not limited to upcycled items tailored to individual/bulk submissions.

ACCESS

  • The Service is provided for personal use only and not for resale or commercial use by third parties.
  • FFM reserves the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
  • Users must be at least 18 years old or under the supervision of an adult to use the Service. Use of the Service is void where prohibited by law.

MODIFICATIONS TO TERMS

FFM may amend these Terms and Conditions at any time. Notification of changes will be posted on the Site or sent via email. Continued use of the Service after such changes indicates acceptance of the updated Terms and Conditions.

PAYMENT

  • FFM accepts standard payment methods such as credit/debit cards, UPI, and other electronic payment systems.
  • Prices listed on the Site are in INR (Indian Rupees) and are subject to applicable taxes.
  • FFM is not responsible for issues arising from third-party payment gateway services.

SHIPPING AND RETURNS

  • Orders are processed in accordance with FFM’s Shipping and Return Policy.
  • The risk of loss and title for purchased products transfers to the User upon delivery to the carrier.
  • Returns or exchanges are not accepted for custom-made or upcycled products unless they have manufacturing defects. Custom-made products include items tailored to User specifications or using User-submitted garments.
  • Disclaimer for Industrial Surplus Option: Industrial Surplus products are dependent on the fabric/clothes procured from post-industrial waste. As such, FFM cannot guarantee the same color or texture as seen in the images. Variations in appearance are inherent to the use of surplus materials and contribute to the uniqueness of each product.

FREE REPAIRS FOR MANUFACTURING DEFECTS

  • FFM offers free repairs for manufacturing defects reported within 15 days of delivery.
  • This policy does not cover damages caused by:
    • Improper use or overloading.
    • Exposure to water, heat, oil, or harsh chemicals.
    • Wear and tear from regular use.
  • Any repairs after this period will be charged at nominal rates, subject to the availability of materials.
  • Products repaired by external services will void FFM’s repair support.

PRODUCT MAINTENANCE

  • Handle products delicately to extend their lifespan.
  • Store items in the provided dust bag when not in use.
  • Avoid overloading and prolonged exposure to direct sunlight, which may cause fading or deformities.
  • Clean gently with a soft, dry cloth; machine washing or dry cleaning is not recommended.

PROMOTIONAL OFFERS

  • Users may receive promotional emails, including special offers, newsletters, or third-party promotions.
  • Promotional discounts, cashback offers, and slab offers are subject to specific terms outlined in the promotional materials.
  • Cashback or discounts cannot be combined with other offers unless explicitly mentioned.

TYPOGRAPHICAL ERRORS

In the event of pricing errors, FFM reserves the right to cancel any orders placed at incorrect prices. Refunds will be issued for canceled orders where payments have been made.

ORDER CANCELLATIONS

By FFM:

  • FFM reserves the right to cancel orders under the following circumstances:
    • Limitations in product availability.
    • Inaccuracies in product or pricing information.
    • Issues flagged by fraud detection systems.
    • Additional verifications not fulfilled by the User.
  • If an order is canceled by FFM after payment, the amount will be refunded to the original payment method.
  • For cancellations related to missed pickups, refer to the User Responsibilities and Restrictions section.

By User:

  • Cancellation requests must be made within 24 hours of placing the order by writing to info@filament.co.in. FFM will review the request and assist the User as necessary.
  • Orders already processed cannot be canceled.
  • Refunds for canceled orders will exclude any voucher used during purchase, which will be reissued to the User’s account.

USER RESPONSIBILITIES AND RESTRICTIONS

Users agree to:

  • Use the Site and Services for lawful purposes only.
  • Ensure that all items submitted for upcycling or pickup are washed and clean before pickup.
  • Avoid activities that may harm the Site, its systems, or other users.
  • Not reproduce, distribute, or exploit Site content without written permission from FFM.
  • Refrain from automated scraping, data mining, or reverse engineering of the Site.
  • Be available for scheduled pickups. Users will be informed in advance of the scheduled pickup date. If the User is unavailable during the first pickup attempt, FFM will coordinate and reschedule another pickup. If the second attempt is also unsuccessful, FFM reserves the right to cancel the order and refund the User the order amount minus the pickup attempt charges incurred due to the use of third-party logistics (TPL) services. Pickup charges cannot be predetermined due to reliance on TPL partners but will be formally communicated to the User at the time of cancellation.

FFM reserves the right to suspend or terminate accounts for misuse of the Service.

USER SUBMISSIONS

By submitting content (e.g., reviews, testimonials, or photos) to FFM, Users grant FFM a royalty-free, worldwide license to use, reproduce, and display the content for marketing purposes. Submissions must not:

  • Violate any laws or third-party rights.
  • Contain offensive or inappropriate material.

FFM may remove or refuse to publish any content at its sole discretion.

CUSTOM-MADE PRODUCT OWNERSHIP

  • FFM retains the rights to use designs, images, or other aspects of custom-made or upcycled products for promotional purposes unless explicitly prohibited by the User in writing.

WARRANTY DISCLAIMER

Products are provided "as is" without warranties of any kind. FFM disclaims all implied warranties, including merchantability or fitness for a particular purpose, to the maximum extent permitted by law.

LIMITATION OF LIABILITY

  • FFM shall not be liable for indirect, incidental, or consequential damages arising from the use of the Site or Services.
  • FFM shall not be liable for the loss of goods when third-party logistics services are used for pickup or delivery. Users must ensure their items are properly packed and ready for pickup. In case of loss, FFM will raise a dispute with the logistics partner and strive to resolve the issue in the best interests of the User but cannot commit to reimbursement for lost items.
  • Product defects beyond the scope of free repairs or replacements are excluded from liability.

FORCE MAJEURE

FFM shall not be held liable for delays or failure in performance caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, pandemics, or acts of government.

TERMINATION

FFM reserves the right to terminate a User’s access to the Site and Services at any time without notice if violations of these Terms and Conditions occur.

COPYRIGHT AND INTELLECTUAL PROPERTY

All content on the Site, including text, images, logos, and designs, is the property of FFM or its licensors and is protected by intellectual property laws. Users may not use or reproduce Site content without explicit permission.

PRIVACY

FFM’s Privacy Policy governs the collection and use of personal data. By using the Site, you consent to FFM’s data practices outlined in the Privacy Policy, including the use of cookies for improving user experience and analytics.

DISPUTE RESOLUTION

This Agreement is governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Himachal Pradesh, India. A grievance mechanism is available, and Users are encouraged to contact FFM at support@filament.co.in for dispute resolution before initiating legal proceedings.

INTERNATIONAL ORDERS

FFM does not currently support international orders placed directly through the Site. Users interested in international orders are requested to contact FFM at info@filament.co.in for assistance.

ELECTRONIC COMMUNICATIONS

By using the Site, you agree to receive communications from FFM electronically. Notices, updates, and agreements will be sent via email or posted on the Site.

MISCELLANEOUS

  • Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions remain in effect.
